این شرایط استفاده برای سرویسهای نویسا شامل چت هوشمند، تولید محتوا، و سایر خدمات مبتنی بر هوش مصنوعی که از طریق وبسایت، اپلیکیشن موبایل یا رابطهای دیگر ارائه میشوند اعمال میگردد. این شرایط یک قرارداد بین شما و نویسا (نوآوران پارسداده ویرا) – ثبت شده در ایران است.
با استفاده از سرویسهای ما، شما این شرایط را میپذیرید. لطفاً این سند را با دقت مطالعه فرمایید.
سیاست حریم خصوصی نحوه جمعآوری و استفاده از اطلاعات شخصی را توضیح میدهد. اگرچه بخشی از این شرایط نیست، اما سند مهمی است که باید آن را مطالعه کنید.
درباره ما
نویسا یک پلتفرم هوش مصنوعی است که خدمات هوشمندی از قبیل: تولید و خواندن تصاویر و فایلها، تولید متن، ایجاد پروژه و گروه برای همکاری افراد با استفاده از هوش مصنوعی و غیره را در اختیار کاربران قرار میدهد. اطلاعات بیشتر در

ثبت نام و دسترسی
برای استفاده از سرویسهای نویسا باید حداقل 13 سال داشته باشید. کاربران زیر 18 سال نویسا نیز باید با اجازه و نظارت والدین یا قیم قانونی خود از این سرویس استفاده کنند.
اطلاعات ثبتنام. شما باید اطلاعات دقیق و کامل برای ثبتنام ارائه دهید. استفاده از شماره تلفن همراه معتبر الزامی است. ورود به حساب کاربری از طریق کد تأیید (OTP) انجام میشود. شما نمیتوانید اطلاعات حساب خود را با دیگران به اشتراک بگذارید و مسئول تمام فعالیتهایی هستید که تحت حساب شما انجام میشود.
اطلاعات شخصی شما از جمله شماره تلفن، نام و سایر دادههای شناسایی، تحت هیچ شرایطی در اختیار هیچ شخص ثالث یا سازمانی قرار نمیگیرد و صرفاً برای بهبود تجربه کاربری و ارائه خدمات استفاده خواهد شد.
استفاده از سرویسهای ما
منوط به رعایت این شرایط، میتوانید به خدمات ما دسترسی داشته باشید و از آنها استفاده کنید. در استفاده از خدمات ما، باید از تمامی قوانین مربوطه و همچنین سیاست اشتراکگذاری و انتشار، سیاستهای استفاده و هر گونه اسناد، دستورالعملها یا سیاستهای دیگری که در دسترس شما قرار میدهیم، پیروی کنید.
کارهایی که نمیتوانید انجام دهید. شما به هیچوجه مجاز به استفاده از سرویسهای ما برای هر فعالیت غیرقانونی، مضر یا توهینآمیز نیستید. در ادامه، چند مثال از مواردی که شما مجاز به انجام آنها نیستید آورده میشود:
- استفاده از سرویسهای ما به گونهای که حقوق کسی را نقض یا پایمال کند.
- اصلاح، کپی، اجاره، فروش یا توزیع هر یک از سرویسهای ما.
- تلاش یا کمک به هر کسی برای مهندسی معکوس، تجزیه یا کشف کد منبع یا اجزای اساسی سرویسهای ما، از جمله مدلها، الگوریتمها یا سیستمهای ما (به جز تا حدی که توسط قانون تعیین شده باشد.)
- استخراج خودکار یا برنامهنویسی دادهها یا خروجی
- اظهار اینکه خروجی توسط انسان تولید شده است در حالی که اینطور نبوده است.
- دخالت یا ایجاد اختلال در سرویسهای ما، از جمله دور زدن هر گونه محدودیت و اقداماتی که ما برای حفاظت بر روی سرویسهای خود اعمال میکنیم.
- استفاده از خروجی برای توسعه مدلهایی که با NEVISA رقابت میکنند.
نرمافزار. سرویسهای ما ممکن است به شما امکان دانلود نرمافزارهایی مانند برنامههای تلفن همراه را بدهند که ممکن است بهطور خودکار بهروزرسانی شوند تا از آخرین نسخه استفاده کنید. این ممکن است شامل نرمافزار متنباز باشد که توسط مجوزهای خاص خود که در اختیار شما قرار دادهایم، اداره میشود.
بازخورد. ما از بازخورد شما قدردانی میکنیم و شما موافقت میکنید که میتوانیم بدون محدودیت یا جبران خسارت برای شما از آن استفاده کنیم.
سیاستهای استفاده مجاز
هدف ما استفاده ایمن و مسئولانه از ابزارهایمان است. نقض این سیاستها ممکن است منجر به محدودیت یا مسدودی دسترسی شما شود.
حفاظت از افراد. شما نمیتوانید از سرویسهای ما برای موارد زیر استفاده کنید:
- تهدید، ارعاب، آزار، اذیت یا افترا
- تشویق یا ترویج خودکشی یا آسیب به خود
- خشونت جنسی یا تولید محتوای غیررضایتی صمیمانه
- تروریسم، خشونت یا خشونت مبتنی بر نفرت
- توسعه یا استفاده از سلاحها
- فعالیتهای غیرقانونی، کالاها یا خدمات غیرمجاز
- ایجاد یا توزیع بدافزار، ویروس یا کدهای مخرب
- ارائه مشاوره تخصصی که نیازمند مجوز حرفهای است (مانند پزشکی یا حقوقی) بدون مشارکت متخصص دارای مجوز
احترام به حریم خصوصی. شما نمیتوانید:
- اطلاعات خصوصی یا حساس افراد را بدون مجوز جمعآوری یا توزیع کنید
- از تصویر یا صدای فرد بدون رضایت او به نحوی استفاده کنید که اصالت آن مبهم شود (deepfakes مضر)
- نظارت غیرمجاز بر افراد انجام دهید
حفاظت از کودکان و نوجوانان. استفاده از سرویسهای ما برای موارد زیر مطلقاً ممنوع است:
- تولید محتوای سوءاستفاده جنسی از کودکان (CSAM)
- فریب یا جذب کودکان و نوجوانان (grooming)
- قرار دادن کودکان در معرض محتوای نامناسب سنی
محتوای ممنوع ورودی. شما نمیتوانید دادههایی به عنوان ورودی وارد کنید که:
- متضمن هتک حرمت و حیثیت اشخاص باشد
- متضمن نفرتپراکنی نسبت به افراد، ادیان یا گروههای جمعیتی باشد
- متضمن محتوای مستهجن یا مبتذل باشد
- ناقض حریم خصوصی یا حقوق مالکیت فکری اشخاص ثالث باشد
در صورت مشاهده هرگونه از اقدامهای بالا در گروههایی که در آن هستید (group chat)، میتوانید فرد مشکوک را گزارش دهید. پشتیبانهای ما آنها را بررسی کرده و در صورت اطمینان، اکانت آنها را مسدود میکنند.
محتوا و مالکیت
محتوا. شما ممکن است ورودی به سرویسها ارائه دهید («ورودی») و خروجی از سرویسها بر اساس ورودی دریافت کنید («خروجی»). ورودی و خروجی در مجموع «محتوا» نامیده میشوند. شما مسئول محتوای خود هستید، شامل اطمینان از اینکه محتوا قوانین قابل اجرا یا این شرایط را نقض نمیکند.
مالکیت محتوا. شما مالکیت ورودی خود را حفظ میکنید و نویسا تمام حقوق، عنوان و منافع خود در خروجی را به شما واگذار میکند.
مشابهت محتوا. به دلیل ماهیت هوش مصنوعی، خروجی ممکن است برای کاربران مختلف مشابه باشد. واگذاری مالکیت فوق شامل خروجی سایر کاربران نمیشود.
استفاده ما از محتوا. نویسا مجاز است از محتوا برای ارائه، نگهداری، توسعه و بهبود سرویسها، رعایت قوانین و اجرای سیاستها استفاده کند.
انصراف (Opt-out). اگر نمیخواهید از محتوای شما برای آموزش مدلها استفاده شود، میتوانید از طریق
تیکت پشتیبانی درخواست دهید. توجه داشته باشید که در برخی موارد این موضوع ممکن است کیفیت خدمات را کاهش دهد.
دقت و صحت خروجیها
هوش مصنوعی حوزهای با تحول سریع است. با توجه به ماهیت احتمالاتی یادگیری ماشین، استفاده از سرویسها ممکن است در برخی موارد خروجیهایی تولید کند که واقعیت را بهدقت منعکس نکند.
هنگام استفاده از سرویسهای ما، شما تأیید و قبول میکنید که:
- خروجی همیشه دقیق نیست. شما نباید به خروجی به عنوان تنها منبع حقیقت تکیه کنید.
- شما باید دقت خروجی را برای کاربرد مورد نظرتان ارزیابی کنید، از جمله استفاده از بازبینی انسانی در صورت لزوم.
- شما نباید از خروجی مربوط به یک شخص برای تصمیماتی که تأثیر قانونی یا مادی بر آن شخص دارد (مانند اعتبار، آموزش، استخدام، مسکن، بیمه، پزشکی) استفاده کنید.
حقوق مالکیت فکری نویسا
تمامی حقوق مالکیت فکری مربوط به سرویس نویسا، شامل وبسایت، لوگو، طراحی رابط کاربری، کدها و الگوریتمها، متعلق به نویسا یا صاحبان مجوز آن است. کاربران حق استفاده، کپی، تغییر یا توزیع این موارد را بدون مجوز کتبی ندارند.
حسابهای مالی و پرداخت
صورتحساب. اگر سرویسی را خریداری میکنید، باید اطلاعات کامل و دقیق صورتحساب ارائه دهید. برای اشتراکهای پولی، بهطور خودکار در هر دوره تمدید نمیشود و در صورت نیاز باید خودتان پس از اتمام پلن، دوباره برای خرید آن از طریق پنل کاربری خود اقدام کنید. شما مسئول تمام مالیاتهای قابل اعمال هستید.
پرداختها غیرقابل بازگشت هستند، مگر در مواردی که قانون الزام کرده باشد.
کاربر با شارژ کیف پول خود، میتواند پلن هم خریداری کند.
توجه: در صورت تمایل به ارتقای پلن از پلن پایینتر به پلن بالاتر (مثلاً از نویسا پلاس به نویسا پرو)، مابهتفاوت هزینه پلنها محاسبه و از شما کسر نخواهد شد و نویسا هیچگونه مسئولیتی در قبال این موضوع ندارد. کاربر میبایست هزینه کامل پلن جدید را بهطور مستقل پرداخت نماید. ارتقای پلن به معنای لغو پلن قبلی و شروع پلن جدید از همان تاریخ است و هیچگونه بازپرداختی بابت مدت باقیمانده پلن قبلی صورت نمیگیرد.
تغییر قیمت. ممکن است قیمتها را تغییر دهیم. اگر قیمت اشتراک را افزایش دهیم، حداقل 3 روز قبل اطلاعرسانی میکنیم.
بازپرداخت. در صورت وجود نقص فنی اثباتشده از سوی نویسا، مبلغ متناسب با مدت باقیمانده به کیف پول قابل بازگشت است. درخواست بازپرداخت تنها از طریق پشتیبانی و حداکثر ۷ روز پس از خرید قابل ثبت است.
خاتمه و تعلیق
خاتمه توسط شما. شما میتوانید در هر زمان استفاده از سرویسهای ما را متوقف کنید.
خاتمه توسط ما. ما این حق را برای خود محفوظ میداریم در صورت تشخیص موارد زیر، دسترسی شما را معلق یا خاتمه دهیم:
- شما این شرایط یا سیاستهای استفاده مجاز را نقض کردهاید
- قانون ما را ملزم به این کار کرده است
- استفاده شما از سرویسها میتواند باعث خطر یا آسیب به نویسا، کاربران یا دیگران شود
- اعتراض. اگر معتقدید حساب شما به اشتباه معلق یا خاتمه یافته است، میتوانید از طریق پشتیبانی اعتراض خود را ثبت کنید.
توقف سرویس
ممکن است تصمیم به توقف ارائه سرویسها بگیریم. اگر چنین شود، از قبل اطلاعرسانی انجام میشود.
سلب مسئولیت
سرویسهای ما «همانطور که هست» ارائه میشوند. ما تضمین نمیکنیم که سرویسها بدون وقفه، دقیق یا بدون خطا باشند. شما میپذیرید که استفاده از خروجیها با مسئولیت کامل خودتان است.
محدودیت مسئولیت
نویسا و وابستگان آن در قبال هیچ خسارت غیرمستقیم، تبعی، خاص یا تنبیهی (شامل از دست دادن سود، حسن نیت، استفاده یا داده) مسئول نخواهند بود؛ حتی اگر از احتمال آن خسارات مطلع بوده باشیم. مسئولیت کل نویسا تحت این شرایط از مبلغی که شما در 6 ماه منتهی به تاریخ بروز خسارت پرداخت کردهاید تجاوز نمیکند.
برخی از شرکتها، سازمانها و مؤسسات اجازه حذف برخی ضمانتها یا محدودیت برخی خسارات را نمیدهند، بنابراین ممکن است برخی از موارد فوق شامل شما نشود.
حل اختلاف
قانون حاکم. این شرایط تحت قوانین جمهوری اسلامی ایران تفسیر و اجرا میشوند.
داوری. هرگونه اختلاف ناشی از یا مرتبط با این شرایط یا سرویسهای ما، ابتدا باید از طریق مذاکره دوستانه حل شود. در صورت عدم توافق ظرف ۳۰ روز، اختلاف به مرکز داوری اتاق بازرگانی، صنایع، معادن و کشاورزی ایران واقع در استان فارس ارجاع میشود و رأی داور قطعی و لازمالاجرا است.
هزینهها. هر طرف مسئول هزینههای داور و هزینههای قانونی خود است، مگر اینکه داور طور دیگری تصمیم بگیرد.
شکایات نقض کپیرایت. اگر معتقدید حقوق مالکیت فکری شما نقض شده است، لطفاً از طریق راههای ارتباطی با ما تماس بگیرید. ما محتوایی که معتقدیم شرایط را نقض میکند حذف میکنیم.
مقررات عمومی
انتقال قرارداد. شما نمیتوانید حقوق یا تعهدات خود را تحت این شرایط منتقل کنید. ما ممکن است حقوق خود را به هر شرکت وابسته یا جانشین منتقل کنیم.
تغییر در این شرایط یا سرویسها. ما ممکن است این شرایط را بهروزرسانی کنیم. در صورت تغییراتی که تأثیر منفی قابلتوجهی بر شما دارد، حداقل ۳۰ روز قبل از طریق پیامک یا اعلان درون محصول اطلاعرسانی میکنیم. سایر تغییرات بلافاصله پس از انتشار در وبسایت مؤثر هستند. اگر با تغییرات موافق نیستید، باید استفاده از سرویسها را متوقف کنید.
تأخیر در اجرا. عدم اجرای یک بند توسط ما به معنای چشمپوشی از حق اجرای بعدی آن نیست.
کل قرارداد. این شرایط شامل تمام قرارداد بین شما و نویسا در مورد سرویسها است و هرگونه توافق قبلی یا همزمان را جایگزین میکند.

These Terms of Use apply to NEVISA's services, including smart chat, content generation, and other AI-based services provided through the website, mobile application, or other interfaces. These Terms are a contract between you and
NEVISA - registered in Iran.
By using our services, you accept these terms. Please read this document carefully.
The Privacy Policy explains how personal information is collected and used. Although it is not part of these Terms, it is an important document that you should read.
About Us
NEVISA is an an Artificial Intelligence platform that provides users with intelligent services such as: generating and reading images and files, generating text, creating projects and groups for people to collaborate using artificial intelligence, etc. More information is available at

Access and Registration
You must be at least 13 years old to use the NEVISA services. NEVISA users under the age of 18 must use the Service with the permission and supervision of their parents or legal guardians.
Registration Information. You must provide accurate and complete information for registration. Use of a valid mobile number is mandatory. Login to the account is done through a verification code (OTP). You cannot share your account information with others and you are responsible for all activities that occur under your account.
Your personal information, including your phone number, name, and other identifying data, will not be shared with any third party or organization under any circumstances, and will only be used to improve user experience and provide services.
Using our Services
Subject to your compliance with these Terms, you may access and use our Services. In using our Services, you must comply with all applicable laws, as well as our Sharing and Disclosure Policy, Usage Policies, and any other documents, guidelines, or policies that we make available to you.
Things You May Not Do. You may not use our Services for any illegal, harmful, or offensive activity. Here are some examples of things you may not do:
- Using our services in a way that violates or infringes anyone's rights.
- Modify, copy, rent, sell or distribute any of our Services.
- Attempt or assist anyone to reverse engineer, decompile, or discover the source code or underlying components of our Services, including our models, algorithms, or systems (except to the extent required by law).
- Automatic or programmatic extraction of data or output
- Stating that the output was produced by humans when it was not.
- Interfere with or disrupt our services, including circumventing any restrictions or measures we place on our services to protect them
- Using the output to develop models that compete with NEVISA
Software. Our Services may allow you to download software, such as mobile applications, which may be automatically updated to ensure that you are using the latest version. This may include open source software that is governed by specific licenses that we provide to you.
Feedback. We appreciate your feedback and you agree that we may use it without restriction or compensation to you.
AUP (Acceptable Use Policies)
We aim to use our tools safely and responsibly. Violations of these policies may result in your access being restricted or blocked.
Protection of Individuals. You may not use our Services to:
- Threats, intimidation, harassment, bullying or defamation
- Encouraging or promoting suicide or self-harm
- Sexual violence or production of intimate non-consensual content
- Terrorism, violence or hate-based violence
- Development or use of weapons
- Illegal activities, unauthorized goods or services
- Creatingor distributing malware, viruses, or malicious code
- Providing specialized advice that requires professional licensing (such as medical or legal) without the involvement of a licensed professional
Respect for privacy. You may not:
- Collect or distribute private or sensitive information about people without permission.
- Use a person's image or voice without their consent in a way that obscures their authenticity (harmful deepfakes)
- Conduct unauthorized surveillance on individuals.
Protection of children and adolescents. The use of our services for the following purposes is strictly prohibited:
- Child sexual abuse content (CSAM) production
- Deceiving or attracting children and adolescents (grooming)
- Exposing children to age-inappropriate content
Prohibited input content. You may not input data that:
- Involves a violation of the dignity and honor of individuals.
- Involves spreading hatred towards individuals, religions or population groups.
- Contains pornographic or vulgar content
- Violates the privacy or intellectual property rights of third parties.
If you see any of the above actions in the groups you are in (group chat), you can report the suspicious person. We will investigate them and, if confirmed, block their account.
Content and Ownership
Content. You may provide input to the Services (“Input”) and receive output from the Services based on the input (“Output”). The input and output are collectively referred to as “Content.” You are responsible for your Content, including ensuring that the Content does not violate applicable laws or these Terms.
Content Ownership. You retain ownership of your Input and the Writer assigns to you all rights, title, and interest in the Output.
Similarity of Content. Due to the nature of artificial intelligence, output may be similar for different users. The above transfer of ownership does not include output from other users.
Our Use of Content. Writers are permitted to use Content to provide, maintain, develop and improve the Services, comply with laws and enforce policies.
Opt-out. If you do not want your content to be used to train models, you can request it via
sending ticket. Note that in some cases this may reduce the quality of the service.
Accuracy and Precision of Outputs
Artificial intelligence is a rapidly evolving field. Given the probabilistic nature of machine learning, using the services may in some cases produce outputs that do not accurately reflect reality.
When using our services, you acknowledge and agree that:
- The output is not always accurate. You should not rely on the output as the sole source of truth.
- You should evaluate the accuracy of the output for your intended use, including using human review if necessary.
- You should not use output about a person for decisions that have a legal or material impact on that person (such as credit, education, employment, housing, insurance, medical).
Writers' Intellectual Property Rights
All intellectual property rights related to the NEVISA service, including the website, logo, user interface design, codes and algorithms, belong to NEVISA or its licensors. Users do not have the right to use, copy, modify or distribute these items without written permission.
Financial and Payment Accounts
Billing. If you purchase a service, you must provide complete and accurate billing information. For paid subscriptions, it will not automatically renew at any time and you must repurchase it through your user panel after the plan expires. You are responsible for all applicable taxes.
Payments are non-refundable, except as required by law.
The user can also purchase a plan by charging their wallet.
Important Note on Plan Upgrades: If you wish to upgrade your plan from a lower tier to a higher tier (e.g., from NEVISA Plus to NEVISA Pro), the price difference between the plans will not be calculated or deducted from your account. NEVISA accepts no responsibility or liability in this regard. You must pay the full price of the new plan independently. Upgrading your plan will result in the cancellation of your previous plan and the start of a new plan from the same date, with no refund or credit for the remaining period of your previous plan.
Price changes. We may change prices. If we increase the price of a subscription, we will provide at least 3 days' notice.
Refund. In the event of a technical defect proven by the writer, the amount proportional to the remaining period can be returned to the wallet. Refund requests can only be submitted through support and no later than 7 days after purchase.
Termination and Suspension
Termination by you. You may stop using our Services at any time.
Termination by us. We reserve the right to suspend or terminate your access if we determine that:
- You have violated these terms or the acceptable use policies.
- The law requires us to do this.
- Your use of the Services could cause danger or harm to writers, users, or others.
- Appeal. If you believe your account was suspended or terminated in error, you can file an appeal with support.
Discontinuation of Services
We may decide to discontinue the Services. If we do, we will provide advance notice.
Disclaimer of Warranties
Our Services are provided “as is.” We do not warrant that the Services will be uninterrupted, accurate, or error-free. You agree that your use of the Outputs is at your sole risk.
Limitations of Liability
In no event will NEVISA and its affiliates be liable for any indirect, consequential, special or punitive damages (including loss of profits, goodwill, use or data), even if we have been advised of the possibility of such damages. NEVISA's total liability under these terms will not exceed the amount paid by you in the 6 months leading up to the date the damage occurred.
Some companies, organizations, and institutions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you.
Dispute Resolution
Governing Law. These Terms shall be construed and enforced under the laws of the Islamic Republic of Iran.
Arbitration. Any dispute arising out of or relating to these Terms or our Services shall first be resolved through amicable negotiation. If no agreement is reached within 30 days, the dispute shall be referred to the Arbitration Center of the Iranian Chamber of Commerce, Industries, Mines and Agriculture located in Fars Province, and the arbitrator’s decision shall be final and binding.
Costs. Each party is responsible for the arbitrator's costs and its own legal fees, unless the arbitrator decides otherwise.
Copyright Complaints. If you believe that your intellectual property rights have been infringed, please contact us via the contact methods. We will remove content that we believe violates the Terms.
General Terms
Transfer of Contract. You may not transfer your rights or obligations under these Terms. We may transfer our rights to any affiliate or successor.
Changes to these Terms or the Services. We may update these Terms. In the event of changes that have a material adverse effect on you, we will provide at least 30 days’ prior notice via SMS or in-product notification. Other changes are effective immediately upon posting on the Website. If you do not agree to the changes, you must stop using the Services.
Our failure to enforce a provision is not a waiver of our right to do so later.
Entire Agreement. These Terms constitute the entire agreement between you and Navisa regarding the Services and supersede any prior or contemporaneous agreements.
